M. Bonomi, L’etica del positivismo giuridico. Dovere e responsabilità nella dottrina pura del diritto di Hans Kelsen

Abstract

Il testo propone un’interpretazione del risvolto morale del positivismo giuridico di Hans Kelsen. Seguendo l’interpretazione del pensiero di Kelsen in chiave trascendentalista fornita da Vincenzo Vitiello, l’autore cerca di valorizzare il pensiero del noto filosofo del diritto in ambito morale. Ne risulta così un empirismo trascendentale applicato al mondo giuridico che viene infine interrogato dall’autore rispetto al ruolo che questo ha avuto nel costituzionalismo europeo e che può avere nel nuovo contesto di “pluralismo delle fonti del diritto” che sembra caratterizzare l’Europa odierna.

Abstract (english)

The article gives an interpretation of the ethical positions underling the legal positivism of Hans Kelsen. Following the transcendental reading of Kelsen’s thought proposed by Vincenzo Vitiello, the author explores the ethical implications of his theory of law. The result of this investigation is a “transcendental empiricism” applied to legal domain. Lastly, the author tries to examine the role of Kelsen’s doctrine in the traditional European constitutionalism and in the new environment of legal pluralism that seems to characterize Europe today.
